These Terms govern your use of the Where's My Car mobile app, website, backend services, and related features. By using the service, you agree to these Terms.
Before publication, replace placeholder company, governing-law, venue, and consumer-rights fields. This document should be reviewed by legal counsel.
1. The service
Where's My Car helps you save where you parked, view the saved location, and navigate back to your vehicle using maps, distance, compass, route, voice guidance, photos, notes, reminders, and related features.
The service is a convenience tool. It is not an emergency service, vehicle security system, professional navigation system, parking operator, or traffic safety system.
2. Accounts
Some features require an account. You agree to provide accurate information, keep your credentials secure, and be responsible for activity under your account.
If you believe your account has been compromised, contact support@wheresmycar.io immediately.
3. Acceptable use
You must not:
- Use the app to stalk, track, harass, or monitor another person without
permission.
- Save or share someone else's vehicle, location, photo, or personal
information unlawfully.
- Upload unlawful, infringing, abusive, misleading, or harmful content.
- Attempt to bypass security, abuse APIs, overload the service, reverse
engineer restricted components, or interfere with the service.
- Use the app while driving or walking in a way that endangers you or others.
- Rely on the app for emergencies, life safety, or vehicle control.
4. Location accuracy and safety
Location accuracy depends on your device, GPS, network conditions, indoor or underground parking structures, map data, and third-party services. We do not guarantee that a saved point, route, compass direction, or distance will always be accurate.
You are responsible for your surroundings, traffic rules, parking rules, and local laws. Do not look at or interact with the app in unsafe conditions.
5. User content
You may add photos, notes, vehicle details, parking details, and profile information. You are responsible for ensuring you have the rights and legal basis to provide that content.
You grant Where's My Car a limited, worldwide, non-exclusive license to host, process, display, transmit, and technically reproduce your content solely to provide and operate the service.
6. Family sharing
Family sharing lets invited members see active parking sessions shared within a family. Only share invite codes with people you trust. You are responsible for the privacy impact of sharing active parking information with family members.
7. Premium subscriptions
Premium features may be offered through monthly or yearly subscriptions. Purchases, billing, auto-renewal, cancellation, refunds, and restore flows are handled by Apple App Store, Google Play, or the applicable store/payment provider.
If you delete your Where's My Car account, your store subscription may remain active unless you cancel it through the relevant store account.
8. Third-party services
The app may rely on third-party services for maps, routing, weather, subscriptions, email, hosting, and app distribution. Their availability, accuracy, limits, pricing, and policies may affect the service.
Third-party services are governed by their own terms and privacy policies.
9. Intellectual property
Where's My Car, the app, design, mascot, branding, software, text, graphics, and related materials are owned by Where's My Car or its licensors. You may not copy, modify, distribute, sell, or create derivative works from them except as allowed by law or with written permission.
10. Changes to the service
We may change, suspend, or discontinue features for operational, security, legal, or product reasons. We will try to provide reasonable notice for material changes when practical.
11. Suspension and termination
We may suspend or terminate access if you violate these Terms, create security or legal risk, abuse the service, or harm other users. You may stop using the service and delete your account at any time.
12. Disclaimers
The service is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.
13. Limitation of liability
To the maximum extent allowed by law, Where's My Car is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, parking fines, vehicle loss, inaccurate location, route errors, third-party outages, or unsafe user behavior.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
14. Indemnity
To the extent allowed by law, you agree to defend and indemnify Where's My Car from claims arising from your misuse of the service, your content, your breach of these Terms, or your violation of law or third-party rights.
